1. Agreement to Terms

1.1. These terms and conditions (“Terms and Conditions”) along with the privacy policy available at https://Khetiox.in/privacy-policy (the “Privacy Policy”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“You” or “User”), and Khetiox (“Company,” “we,” “us,” or “our”), concerning your access to and use of the Khetiox website (“Site”) and mobile application, including all services provided therein (collectively, the “Services”).

1.2. By accessing or using the Site and Services, you agree that you have read, understood, and accept all the terms and conditions in this Agreement. If you do not agree with any of these terms, you must discontinue use of the Site and Services immediately.

1.3. Khetiox reserves the right to modify these Terms and Conditions at any time without prior notice. Any changes will be effective immediately upon posting. Continued use of the Site and Services after any such modifications signifies your acceptance of the updated Terms and Conditions. It is recommended that you review the Terms and Conditions periodically to stay informed of any changes.

2. Membership Eligibility

2.1. The Site and Services are available only to persons who can form legally binding contracts under applicable law. Use of the Site by minors (individuals under 18 years of age) or those who are legally incompetent is not allowed. If a minor or legally incompetent individual wishes to use the Site, their legal guardian or representative must register as the User and take responsibility for the use of the Site and Services.

2.2. Khetiox reserves the right to terminate your membership and deny access to the Site and Services if it is discovered that you are under the age of 18 or otherwise incapable of forming legally binding contracts.

3. Services Offered

3.1. The Site offers the following Services:

3.1.1. An online marketplace for trading livestock, enabling you to list your livestock (such as goats, pigs, and poultry) and connect with potential buyers directly.

3.1.2. A platform for booking veterinary appointments, where you can schedule instant or pre-scheduled consultations with certified veterinarians. This service allows you to obtain professional advice regarding the health, behavior, and care of your livestock.

4. User Conduct and Rules on the Site

4.1. By using the Site, you agree to abide by the following rules:

4.1.1. You shall not upload, post, or share any content that:

  • Belongs to another person without their consent.
  • Is harmful, defamatory, obscene, or otherwise illegal.
  • Misleads others or engages in fraudulent activities.
  • Infringes upon the intellectual property rights of others.
  • Promotes illegal activities or violence.
  • Violates any applicable laws or regulations.

4.1.2. Any additional terms or documents posted on the Site are incorporated by reference into this Agreement.

4.1.3. We may update or change the Site to reflect changes in our Services or business priorities. Such changes will be made at our sole discretion and without prior notice.

4.1.4. The Site is intended for users residing in India. Use of the Site in any other jurisdiction where such use would be illegal is strictly prohibited.

4.1.5. The Site and Services may not be used for any commercial activities other than those explicitly authorized by Khetiox.

5. Online Medical Services

5.1. Notwithstanding anything contained under this Agreement, it is hereby clarified that Khetiox is not a medical service provider, nor is it involved in providing any healthcare services, medical advice, or diagnosis. Khetiox is merely a digital intermediary platform that facilitates the connection between medical professionals and Users through the Site. Therefore, Khetiox shall not be responsible for or liable to the User for any outcome from the booking or consultation between You and the medical professional. The Site offers options to book both instant and pre-scheduled consultations with Practitioners based on their availability.

5.2. The Site and our Services are not intended to replace traditional veterinary care but are meant to supplement it. The User acknowledges and agrees that online consultations have inherent limitations, as Practitioners will not be conducting physical examinations of the Users' animals, and thus may not obtain critical information typically derived from such examinations. The User agrees to assume all risks associated with these limitations.

5.3. Khetiox facilitates the connection between Users and Practitioners through its Site. Users can submit queries that are answered by Practitioners through various communication methods, including audio calls, video calls, text-based chat, or other methods as determined by Khetiox from time to time.

5.4. All consultations, including video consultations, chat consultations, text messages, audio recordings, videos, transcripts, prescriptions, email, and hard copy correspondences (collectively, “Information”) between Users and Practitioners shall be recorded, saved, and stored for record-keeping purposes and may be produced as evidence upon the direction of a court of law. Khetiox may review this data periodically for quality evaluation purposes, and all such Information is subject to the Privacy Policy.

5.5. Practitioners providing online medical services through the Site are expressly prohibited from:

  • Posting responses containing derogatory language, objectionable, pornographic, or offensive content.
  • Advertising any brand of drugs, supplements, vaccines, or medications in any manner whatsoever.
  • Soliciting Users or advertising through unauthorized means, including social media, telephone numbers, or addresses.
  • Promoting content or activities that are illegal.

5.6. The User understands and agrees that Khetiox will NOT be liable for:

  • User interactions and associated issues with Practitioners, including content generated through the Services or provided by the Practitioner.
  • The suitability, ability, or intent of the Practitioner to fulfill their obligations toward Users, including delayed responses.
  • The quality or appropriateness of medical treatment or any medical negligence by the Practitioner.
  • Inappropriate treatment or any inconvenience suffered by the User due to the Practitioner’s actions or inactions.
  • Misconduct or inappropriate behavior by the Practitioner or their staff.
  • Cancellation, no-shows, rescheduling of appointments, or variation in fees charged by the Practitioner.
  • Any pre-existing medical condition or adverse reactions to prescribed drugs.
  • Sudden escalation of medical conditions due to incomplete or inaccurate health information provided by the User.

5.7. As a User of this Site, You agree not to:

  • Systematically retrieve data or content from the Site to compile a database or directory without written permission from us.
  • Make unauthorized use of the Site, including collecting usernames or email addresses of Users to send unsolicited email.
  • Use a purchasing agent to make purchases on the Site.
  • Circumvent, disable, or interfere with security-related features of the Site.
  • Engage in unauthorized framing or linking to the Site.
  • Trick, defraud, or mislead us or other Users, particularly to obtain sensitive account information.
  • Abuse our support services or submit false reports of abuse or misconduct.
  • Engage in automated use of the system, such as using scripts or data mining tools.
  • Interfere with or create an undue burden on the Site or its networks.
  • Impersonate another user or person or use another’s username.
  • Sell or transfer your profile.
  • Use information obtained from the Site to harass, abuse, or harm another person.
  • Use the Site or its content to compete with us or for any unauthorized commercial purpose.
  • Decipher, decompile, disassemble, or reverse engineer any software on the Site.
  • Harass, annoy, intimidate, or threaten our employees, agents, or other users.
  • Delete copyright or proprietary rights notices from the content.
  • Upload or transmit viruses, Trojan horses, or other harmful material that interferes with the Site's operation.
  • Engage in any automated use of the system or disparage, tarnish, or otherwise harm Khetiox.
  • Use the Site in a manner inconsistent with applicable laws or regulations.
  • Falsely imply a relationship with Khetiox or another company.

5.8. You agree that sending unsolicited email advertisements or other unsolicited communications to Khetiox’s email addresses or through Khetiox’s systems is prohibited. Khetiox may monitor email usage to flag potential spam or scam communications. Unauthorized use of Khetiox’s Services is a violation of these Terms and Conditions and applicable laws, potentially subjecting you and your agents to civil and criminal penalties.

5.9. Users agree that follow-up consultations prescribed by Practitioners based on online consultations shall be routed through the Site only.

5.10. Users are only permitted to obtain one consultation per User for each single booking of online consultation services. Attempts to obtain consultation for more than one User through a single booking will not be addressed by the Practitioner.

6. Termination of Use

Khetiox reserves the right, in its sole discretion, to terminate or suspend your access to all or part of the Site and Services, for any reason, without notice. Upon termination, your right to use the Site and Services will immediately cease.
